There were a number of serious difficulties with the judge's approach to the first defendant's equity and with the regime which he had put in place to implement it, such that his order could not stand. However, the Court of Appeal, Civil Division, dismissed the first claimant's challenge to the judge's findings of fact, namely, that the first defendant had been promised a farm and business.
