As it had been within the first respondent independent Public Service Commissioner's (the PSC) power to choose to make use of examination results set and marked by a body appointed by the Cabinet, it had been within the second respondent Public Service Examination Board's power, once Constitutionally appointed by the PSC, to choose to adopt the results of an examination set and marked by a body appointed by the Minister. Accordingly, the Privy Council dismissed the appellant's appeal against the Court of Appeal of Trinidad and Tobago's decision, affirming the dismissal of his judicial review proceedings.
