Migliaccio v Migliaccio

Family proceedings – Orders in family proceedings. The Family Division held that the wife, by having proved the existence of the order made under the Matrimonial Causes Act 1973 and the default, had raised a case to which the husband had comprehensively failed to answer. In the circumstances he was culpable for the purposes of s 5 of the Debtors Act 1869. Further the entire sum was enforcement by way of judgment debt.
