European Union – Public procurement. The Court of Justice of the European Union gave a preliminary ruling in which it decided that arts 2, 23(2) and (8) of Directive (EC) 2004/18 and art 34 of the Treaty on the Functioning of the European Union (TFEU), read in conjunction with art 36 TFEU, should be interpreted as precluding a clause in the tender specifications for a public contract which, in accordance with the law of the member state to which the contracting authority belonged, required medicinal products derived from plasma, which were the subject matter of the public procurement at issue, to be obtained from plasma collected in that member state.
