Landlord and tenant – Action for possession. The trial judge had erred in law in finding that there had been an agency relationship between the first and second defendant and accordingly that the first and second defendant had entered into possession of the property as secure tenants. The Court of Appeal, Civil Division further held that it was not disproportionate, having regard to art 8 of the European Convention on Human Rights to grant the authority the possession of the property.
