Massimo Osti SRL (a company incorporated under the laws of Italy) v Global Design and Innovation Ltd and another

Trade mark – Infringement of trade mark and breach of contract. The claimant Italian company's application to set aside an order, transferring its claim for breach of contract and trade mark infringement from the High Court to the Intellectual Property and Enterprise Court (the IPEC) was dismissed. The IPEC ruled that all of the factors in the case pointed clearly to the conclusion that the claim was suitable for the IPEC and that it ought not to be retained in the High Court.
