Costs – Indemnity costs. The approach adopted by the Upper Tribunal (Lands Chamber) in determining the appellants' application for costs had not been wrong in principle. The Court of Appeal, Civil Division, held that it should not overturn the decision not to award successful appellants their costs of pursuing claims for compensation against the respondent Transport for London on the indemnity basis, where the compensation awarded to them had exceeded offers of settlement made by them before the hearing.
