Malarz v Regional Court of Opole, Poland

Extradition – Extradition order. There had plainly been a degree of inefficiency, which bordered on incompetence, with respect to the appellant's extradition to Poland for assault, but he did not come close to establishing an abuse of process. The Divisional Court, in dismissing his appeal against the extradition orders, further held that the factors relevant to the appellant's rights under art 8 of the European Convention on Human Rights had not outweighed the public interest in extradition.
