Magiera v District Court Of Krakow, Poland

Extradition – Extradition order. On material which was much more extensive than that which had been before the judge in ordering the appellant's extradition to Poland, it would be oppressive to extradite him by reason of his physical health and, therefore, extradition was barred by the Extradition Act 2003 s 25. The Administrative Court further held that the present case was a rare one where it would be disproportionate and, therefore, in violation of the appellant's rights under art 8 of the European Convention on Human Rights for him to be extradited.
