Immigration – Deportation. The Court of Appeal, Civil Division, dismissed the appellant Secretary of State's appeal against the decision of the Upper Tribunal (Immigration and Asylum Chamber) (the UT), refusing to order that the respondent foreign criminal be deported. The UT had been entitled to hold that there had been very compelling circumstances, which had outweighed the high public interest in deportation, in particular, the long delay by the Secretary of State in taking action to deport was an exceptional circumstance.
