MLS (Overseas) Ltd v Secretary of State for Defence

Public procurement – Public contracts. The claimant company (MLS) was entitled to a declaration that the Ministry of Defence (the MOD) had acted unlawfully in a tendering process for logistics, which the claimant had failed to win. The Technology and Construction Court held that the MOD had acted in breach of its obligations of transparency and equal treatment, in applying criteria that had been arbitrary or not sufficiently clear from the invitation to tender and rejecting MLS's tender on that ground.
