Lusinga v Nursing and Midwifery Council

Medical practitioner – Appeal against determination of disciplinary committee. The Administrative Court allowed the appellant's appeal against the decision of a panel of the respondent Nursing and Midwifery Council, finding that he had dishonest concealed his additional nursing employment and striking him off the register. None of the mitigating features were mentioned in the panel's decision and it had been unfair to hold against the appellant an alleged change of position when what had changed had been the case under the poorly drafted dishonesty charge.
