European Union – Public procurement. The applicant company had sought a declaration that the European Commission had not been entitled to request it to repay advances paid under three agreements and that the appellant had not been required to pay liquidated damages to the Commission, as had been ordered following an earlier decision of the General Court of the European Union in February 2016. The Court of Justice of the European Union, in dismissing the appeal, held that none of the applicant's grounds for challenging the earlier decision had any merit or had been admissible.
