Extradition – Procedure – Statement of uncontroversial evidence ('SUE'). Sheriff Court: In extradition proceedings in which the requested person, whose extradition was sought by the Russian Federation, lodged two SUEs, the Crown lodged notes of challenge thereto and the requested person applied to the court for a direction that the challenges be disregarded, the court held that the procedure relating to SUEs was available in extradition proceedings, there being no special circumstances in extradition proceedings which prevented s 258 of the Criminal Procedure (Scotland) Act 1995 from applying, and s 258 had been timeously invoked, however the court declined to exercise the power to direct that the challenges be disregarded as they could not be described as unreasonable.
