London Borough of Hackney v Williams and another

Local authority – Statutory powers. The Court of Appeal, Civil Division allowed an appeal by the local authority against a finding that the authority had failed to comply with its statutory duty under the Human Rights Act 1898 and were liable to pay damages to the parents in respect of non-consensual separation of the children which breached art 8 of the Convention. The court found that s 20 of the 1989 Act had not required consent to be established.
