The Queen's Bench Division, after determining that it had a discretion to exercise if the criteria in CPR 17.4(2) were satisfied, exercised that discretion to refuse the claimant permission to add new claims to her defamation proceedings against the defendant. However, it allowed her to rely on specified matters to expand by amendment her case on damages, by adding details of matters to be relied on in aggravation.
