Civil procedure – Reduction of interlocutor. Court of Session: Allowing a reclaiming motion in an action, which the Lord Ordinary had dismissed, in which the pursuer sought reduction of an interlocutor refusing leave to appeal against an earlier interlocutor and making payment of the expenses of process to date a condition precedent to proceeding with a professional negligence action, the court was not persuaded that, if the pursuer proved his averments, he would necessarily fail to establish circumstances amounting to a miscarriage of justice; the court also set out the procedure which ought to follow an interlocutor making payment of expenses a condition precedent.
