Having regard to the proper approach, the defendant Secretary of State had been entitled to conclude that the new material relied on by the claimant Somali national, taken with the material she had already considered, had not created a realistic prospect of success before the First-tier Tribunal (Immigration and Asylum Chamber). Accordingly, the Administrative Court dismissed the claimant's application for judicial review of her refusal to accept his representations as a fresh claim for asylum.
