Extradition – Abuse of process. Given the appellant's undoubted acquittal by a competent court in relation to nine substantive offences of tobacco smuggling, and the absence of any undertaking on instructions or other viable guarantee as to the non-resurrection of those offences, the criteria in Zakrzewski v Regional Court in Lodz, Poland ([2013] 2 All ER 93) were met. Accordingly, the orders for the appellant's extradition in relation to those offences was quashed, but not as to one offence of criminal association in connection with tobacco smuggling.
