Conflict of laws – Foreign judgment. The Queen's Bench Division allowed the appellants appeal against the enforcement of a judgment in the Civil Court in Malta in England and Wales against the appellant. The judgment had been given in proceedings that had been commenced in April 1987 arising out of a fire which had occurred in Malta the previous month. There had therefore been a delay of nearly 26 years before judgment was issued which in all the circumstances was a breach of art 34 of Regulation (EC) 44/2001 (Brussels 1).
