Lambeth London Borough Council v Secretary of State for Communities and Local Government

Town and country planning – Use of land. The proper reading of planning permission granted by the claimant local planning authority, as ambiguously varied in 2014, permitted unrestricted retail use for the sale of all goods, including food. Accordingly, the Planning Court dismissed the authority's application to quash the decision of the inspector appointed by the defendant Secretary of State to allow an appeal against its refusal to grant a certificate of lawfulness of proposed use or development.
