The judge had been justified in his conclusions and there was no proper basis for interfering with the exercise of his discretion to order documents be returned, all copies be destroyed and restraining the defendants from disclosing or using any legal professional privileged information contained in them, subject to specified exceptions. Accordingly, the Court of Appeal, Civil Division, dismissed the defendants' appeal against that decision.
