Indemnity – Charterparty. The Commercial Court allowed an appeal by the charterer, L, against the holding of an arbitral tribunal by which it had held that L was not entitled to seek an award for an indemnity against A, to whom the vessel had been chartered. The sum had become legally liable to be paid, the amount of L's loss had been ascertained, and security had been provided in that sum. It had not been open to the tribunal to deny L, as the entity indemnified, the consequences of that position.
