Injunction – Interim injunction. The Commercial Court dismissed the claimant company's application for an interim injunction to prevent the release, to the first defendant company, of sums in an escrow account which were held by the second defendant bank to facilitate payments under two share sale and purchase agreements (SPAs). The court held that there was no serious issue to be tried where, among other things, an arbitration tribunal had made a final adjudication on the relevant issue, namely that the claimant's damages claim against a party to the first SPA was not a relevant claim, under that SPA.
