Civil procedure – Expenses – Interim payment of expenses. Court of Session: In an action in which the court had found the defenders liable to the pursuer for the expenses of a minute of amendment, of the discharge of a diet of proof and half of the expenses of the action to date on an agent and client, client paying basis, and the pursuer enrolled a motion for payment of £2m as an interim payment of expenses, the court held that it was within the court's discretion to make an order for interim payment where expenses had been awarded but the account had not yet been lodged and taxed provided it was satisfied that there was sufficient reason for so doing: in the court's opinion there was sufficient reason to grant the pursuer's motion and the court granted it to the extent of ordering the defenders to make an interim payment to the pursuer of £1m.
