In order TO enable the court to address common issues that arose where a person had been accused of obtaining an English language certificate known as the Test of English for International Communication (TOEIC) certificate through the use of deception, in particular by using a proxy test-taker, the Court of Appeal, Civil Division, agreed a compromise. It was appropriate for cases of the present type to proceed through the human rights appellate route, providing that the respondent, Secretary of State, was willing to give the appropriate assurance.
