Negligence – Causation. The Queen's Bench Division held that the claimant was suffering from post-traumatic stress disorder as a result of carbon monoxide poisoning, for which the defendant NHS Trust admitted liability. Consequently, the claimant, who had been dismissed from the NHS Trust in 2015 and was unfit to work at the present time, was entitled to damages on the basis that, but for the carbon monoxide poisoning, her employment would have continued and it was unlikely that she would have suffered a major psychological disorder in the foreseeable future.
