Kean v Lucas (as Liquidator of J&R Builders (Norwich) Ltd)

Company – Administration. The Companies Court held that the exercise to be undertaken by a liquidator when deciding whether or not to accept a claim at the requisition stage did not need a 'reasonable assessment' of the quality of the claim. The exercise a liquidator should carry out in order to determine whether or not the threshold of 25% in value of the company's creditors had been reached did not include a 'strict proof' test.
