Immigration – Refugee. The Court of Justice of the European Union ruled that art 19(2) of European Parliament and Council Regulation (EU) 604/2013 was applicable to a third-country national who, after seeking asylum in a member state, provided evidence that he had left the member states for at least three months before making a new asylum application in another member state. Further, an asylum applicant might, in an action challenging a transfer decision, invoke an infringement of the rule set out in the second sub-paragraph of art 19(2) of that regulation.
