Human rights – Right to fair trial. The Divisional Court determined how the Justice and Security Act 2013 and the CPR should be interpreted in accordance with the duty not to act in a manner inconsistent with art 6 of the European Convention on Human Rights. It then held that sufficient information about allegations against the claimants to enable the effective giving of instructions in relation to those allegations was not required, but that it was not required that there be no disclosure which might harm national security.
