Town and country planning – Grant of planning permission. Court of Session: Refusing a judicial review petition in which a local community council sought reduction of a decision granting planning permission in principle for a large residential development, the court rejected the petitioner's contentions that there had been material changes in relation to green space and public transport provision in the period between the resolution to grant planning permission and the grant of permission in principle and that in failing to return the application for permission in principle to its planning committee for reassessment as regards those changes the respondent failed to fulfil its statutory duty, proceeded on an incorrect factual basis and failed to take into account material considerations.
