The Administrative Court held that the defendant local authority's Housing Appeals and Review Panel (the HARP) had been entitled to make a decision that the brother of the claimant's (C) civil partner (J) was not a dependent member of the family, upon the claimant being served with a notice to quit after C's father had died. In the circumstances, the letter from J's GP had not said that J could not live independently, and the HARP had been entitled to take the view that J's medical condition was not sufficient to have rendered him a dependant of C and his civil partner.
