The Court of Appeal, Civil Division allowed an appeal by the defendant boat owner against a decision that a defence under art 8 of the European Convention on Human Rights should have been struck out summarily on the basis that the claimant's position as the statutory body, entrusted with management of the waterways, was broadly analogous for present purposes to that of housing authorities bringing possession proceedings in respect of residential premises.
