Landlord and tenant – Right to buy. In relation to setting the price of property when exercising enfranchisement rights under the Leasehold Reform Act 1967, the preferential rights of the Mosley v Hickman class had not been taken away by the further tranche of amendments to the 1967 Act brought about by the 2002 Act so the Court of Appeal, Civil Division held in determining a dispute between the landlord and tenant regard the price of a property for enfranchisement. In coming to that decision the Court reversed the decision of the Upper Tribunal(Lands Chamber).
