European Union – Trade marks. The First Board of Appeal of the European Union Intellectual Property Office had correctly found that there was no likelihood of confusion between the figurative trade mark 'HISPANITAS JOY IS A CHOICE', sought to be registered as an EU trade mark by the intervener company, and an earlier EU word mark 'JOY'. Accordingly, the General Court of the European Union dismissed the action by the applicant company, registered in the UK, for annulment of the Board's decision.
