The claimant was unsuccessful in his claim against his employer, the defendant NHS Trust, for breach of contract, specifically the obligation of trust and confidence. The Queen's Bench Division held that although the Maintaining High Professional Standards in the Modern NHS (MHPS) guidance was relevant, it was not contractually incorporated. Further none of the defendant's actions either singularly or cumulatively amounted to a breach of contract (mostly relating to the term of trust and confidence).
