The point of principle, namely whether the appellant Sri Lankan and Mauritian nationals' children who had been born in the UK and others in a similar position were 'persons from abroad', within the meaning of the s 185 of the Housing Act 1996, although important, could be left to be determined as and when it had a real impact on the legal rights of the parties concerned. The Court of Appeal, Civil Division, in dismissing the academic appeal, held that the important point of law and reasonable prospect of success were insufficient to justify the continuation of the appeal.
