Environment – Protection. The Commercial Court held that the claimant electricity generator did not succeed in showing that it had suffered the losses it claimed by reason of the defendant's admitted breach of their contract to provide services for the purposes of it meeting its obligations under the Electricity and Gas (Community Energy Savings Programme) Order 2009, SI 2009/1905. In one respect, the claim failed on its facts and, in the second, measures to mitigate a potential fine had been, as with a fine itself, the claimant's responsibility.
