Court of Session: Refusing judicial review petitions in which three asylum seekers challenged the Home Secretary's certification that their claim that returning them to Italy would breach their right not to be subjected to inhuman or degrading treatment was clearly unfounded, the court held that there was insufficient evidence from which a First-tier Tribunal could consider that were the petitioners to be returned to Italy there was a substantial risk that the conditions in Italy would amount to a violation of their rights under art 3 of the European Convention on Human Rights.
