Insurance – Insurance policy – Liability to indemnify – Failure to disclose/ misrepresentation of facts material to appraisal of risk. Court of Session: In an action in which the pursuer sought indemnity from the defenders, its insurers, in respect of a fire at the pursuer's property, and in which the defenders sought to avoid the pursuer's insurance policy on the basis of its failure to disclose or misrepresentation of facts material to the appraisal of risk under the policy, the court concluded that none of the factors the defenders relied on amounted to material failure to disclose or material misrepresentation.
