Negligence – Duty to take care. The first defendant company had clearly been in breach of its duty of care to the deceased, with respect to his development of mesothelioma, and it would not be an overstatement of the position to say that the second and third defendants' conduct had amounted to that of joint tortfeasors. Accordingly, the Queen's Bench Division held that the defendants had been liable for the deceased's mesothelioma which had developed as a result of his exposure to asbestos at work.
