Costs – Appeal. In a costs assessment for a personal injury claim, the judge had been correct to treat a risk assessment as a relevant factor when considering the percentage increase of the success fee pursuant to CPR 46.9(4). Accordingly, the Queen's Bench Division dismissed the defendant law firm's appeal against, among other things, the reduction of the success fee under the conditional fee agreement from 100% to 15%.
