Passing off – Descriptive name. The claimants' claim regarding the use of the trading name '***' in the defendants' cactus shop failed. The Intellectual Property Enterprise Court held that, among other things, the first claimant, who was the proprietor of a tattoo shop that also used the word '***' in its name, had not proved that there had been a material misrepresentation that the goods and services offered by the defendants were those of the claimants or were somehow authorised by or connected with the claimants.
