Particulars of claim – Amendment. The Queen's Bench Division dismissed the claimant's application to amend her particulars of claim, in a case where she sought damages from the defendant NHS trust for personal injury in the form of psychiatric harm, and for the consequences of killing her mother, where the defendant had been criticised for a failure to act in a timely manner to a significant deterioration in the claimant's mental health condition. The court held that the claim was insufficiently particularised, and that fairness, and the need to ensure proportionality and efficiency, all favoured the refusal of the grant of discretion to allow the amendments to be made.
