The claimant's spinal orthopaedic surgeon had used reasonable care and skill in carrying out her C5/6 decompression and disc replacement, and the cause of her spinal cord injury could not be identified. However, the Queen's Bench Division, in awarding the claimant £4.4m, found that she had not given informed consent to the operation and that, if she had been given information about material risks and conservative treatment, she would not have agreed to the operation.
