The Employment Appeal Tribunal, in allowing the employee's appeal against the employment tribunal's dismissal of his claims for, among other things, unfair dismissal, race and age discrimination and whistle blowing, held that the striking out of the claims had been so tainted by procedural unfairness that the judge's ruling that none of the claims had any reasonable prospect of success could not be allowed to stand.
