Employment – Limitation. The employer sought to appeal against the employment tribunal's ruling that the employee's claims for unfair dismissal, race discrimination and wrongful dismissal, had been presented in time and should proceed to a full hearing. The Employment Appeal Tribunal (EAT) held that the need for clarity concerning the construction of the extension of time provisions, under the early conciliation regime, as contained in s 207B of the Employment Rights Act 1996, provided compelling reason for the appeal to be heard.
