Personal Injury: Quantum Case. Road traffic accident. Orthopaedic injuries, psychiatric and psychological damage. PSLA of £4,000. The claimant sustained a severe sprain/strain to her neck and a soft tissue injury to the thoracic spine. The prognosis for both injuries was for recovery within nine months. The claimant suffered shock for two days. She was diagnosed with a mild simple phobia related to travel. She had great difficulty learning to drive and avoided social events to avoid having to take a lift. Witnessing a near miss or a video of a car crash brought back the accident, resulting in distress. The prognosis with CBT was for resolution within 14 to 20 months. Sleep, housework, personal care, bending and stretching were restricted.
