Sheriff Court: In an opposed application for expenses by the claimant in an action for payment in which the dispute concerned the level of expenses recoverable where a simple procedure action had initially been defended and then settled by tender and acceptance before the evidential hearing, the court held that the claimant's entitlement to expenses should not, as the respondent contended, be restricted to 10% of the sum of £3,000 which was ordered to be paid.
