Government of India v Chawla

Extradition – Prohibition on torture. There remained a real risk that, if the respondent was extradited and held at a specified prison, he would be subjected to inhuman or degrading treatment contrary to art 3 of the European Convention on Human Rights. Accordingly, the Divisional Court stayed the requesting state's appeal against the respondent's discharge from extradition for allegedly acting as a conduit between bookies who wanted to fix cricket matches and Hansie Cronje, then captain of the South African test cricket team, to give the requesting state an opportunity to provide further assurances.
